Well its hardly a big deal. One little emmiter, its not like someone brought back a bunch of armour tech and torpedoes.

Good point. When Starfleet Engineering "studies" it (ie confiscates it) what is the Doctor supposed to do? No more freedom, I guess.

Well, I suppose a battle for Holographic rights is on the horizon anyway. But couldn't it be argued that Data was constructed by a federation citizen and could live and exist independantly, but the EMH was created for starfleet, by a starfleet officer (is Zimmerman starfleet?), in a starfleet computer, uses starfleet holoprojectors and so forth. After all, that's what he is, a starfleet program. Wouldn't that make the emitter starfleet property by default?

Yeah, that case has the potential to get very messy. If the Doctor gets his rights, then do all EMHs get them? After all, they're the exact same programs with the same mentality. The Doctor just got left on a bit longer than normal.

Not really. The doctor expanded because Janeway let him do it. No other hologram would be under those conditions normally and if they are they deserve the same rights as others.

Janeway didn't specifically "allow" him to evolve; she just didn't stop what was a natural process of being on for far longer than the EMH program was intended. As far as "preferred" timeline meaning "preferred by the 29th century Federation," that sounds WAY too arbitrary to NOT be in violation of the Temporal PD.
