Along with the other times he saved the day.
Theoretically the "ECH" incident could have been broadcast from a faux bridge on the holodeck.

Uphold the "preferred timeline". That soooo sounds like a violation of the temporal prime directive :D

Well its hardly a big deal. One little emmiter, its not like someone brought back a bunch of armour tech and torpedoes.

As I said, the creation of the superborg "One" in "Drone" demonstrated the potential impact this device could have.

When Voyager does get home, you can be damned sure that Starfleet Engineering would take an interest in that device and extrapolate from it...

Good point. When Starfleet Engineering "studies" it (ie confiscates it) what is the Doctor supposed to do? No more freedom, I guess.

But if he can claim he is his own person like Data did then he can claim it as his property.

In the case of 29th century tech, though, I'm pretty sure some admiral somewhere would, emm, bend the rules...

Well, I suppose a battle for Holographic rights is on the horizon anyway. But couldn't it be argued that Data was constructed by a federation citizen and could live and exist independantly, but the EMH was created for starfleet, by a starfleet officer (is Zimmerman starfleet?), in a starfleet computer, uses starfleet holoprojectors and so forth. After all, that's what he is, a starfleet program. Wouldn't that make the emitter starfleet property by default?

But if he can past the tests of sapience then he is classed as a life form and has all of their rights.

That's a BIG if. I would stay so far away from that courtroom, that I'd need a subspace booster to find out if it's over.

Yeah, that case has the potential to get very messy. If the Doctor gets his rights, then do all EMHs get them? After all, they're the exact same programs with the same mentality. The Doctor just got left on a bit longer than normal.
Then what about other holograms? What about those created in the holodeck?
A pro-hologram lawyer could cause a lot of havock.

The reason the doctor is special is because he evolved, he added to his existing programming.

Other holograms are not self aware and do not care if they are deleted.

But here's the thing: if you leave one on long enough then they'll do the same as the Doctor did. That is, after all, the only reason the Doctor turned out like he did.

Not really. The doctor expanded because Janeway let him do it. No other hologram would be under those conditions normally and if they are they deserve the same rights as others.

Janeway didn't specifically "allow" him to evolve; she just didn't stop what was a natural process of being on for far longer than the EMH program was intended. As far as "preferred" timeline meaning "preferred by the 29th century Federation," that sounds WAY too arbitrary to NOT be in violation of the Temporal PD.
