A Mount Vernon teacher undermined science instruction in the public school district by discrediting evolution in his classroom and focusing on creationism and intelligent design, a probe has found.

Eighth-graders who were taught by John Freshwater frequently had to be re-taught in high school what they were supposed to have learned in Freshwater's class, according to outside investigators hired by the district.


For 11 years, other teachers in the school district and people in the community complained about Freshwater preaching his Christian beliefs in class and slamming scientific theories, a school administrator told investigators.

"There is a significant amount of evidence that Mr. Freshwater's teachings regarding subjects related to evolution were not consistent with the curriculum of the Mount Vernon City Schools and state standards," the consultants reported.

Freshwater had been told to stop teaching intelligent design and creationism, but he continued, the report found.


HR on Call Inc., the consultants who investigated allegations against Freshwater, released their findings today. Mount Vernon school board members will meet today to discuss the report and decide what, if any, action they will take.

The report confirms that Freshwater burned crosses onto students' arms, using an electrostatic device, in December. Freshwater told investigators the marks were Xs, not crosses. But all of the students interviewed in the investigation reported being branded with crosses. The investigation report includes a photo of one student's arm with a long vertical line and a short horizontal line running through it.


The family of one student who was burned filed a federal lawsuit last week against Freshwater and the district, saying the student's civil rights were violated.

Today, the family's attorney, Jessica Philemond, said it was unfortunate that the school district didn't do anything sooner to stop Freshwater.

"These concerns had been going on for at least 11 years and the school had not done anything," she said.

A teacher who worked in Freshwater's classroom last year also reported to investigators that Freshwater told his class that homosexuality is a sin.

Neither Freshwater nor his attorney, Roger Weaver, could be reached for comment last night. Freshwater's friend, Dave Daubenmire, defended him.

"With the exception of the cross-burning episode I believe John Freshwater is teaching the values of the parents in the Mount Vernon school district,'' he said.

Daubenmire is a former London High School football coach whose district was sued in 1999 by the American Civil Liberties Union because he led his players in prayer at games, practices and meetings.

"Do you think there are other teachers in the public classroom that are trying to drive their opinions in the classroom?'' Daubenmire asked. "I don't care who you are. You cannot separate your value system from your teaching.''

The debate about Freshwater's actions became public in April after he refused to remove a Bible from his desk, as the district had ordered.

The report says he was insubordinate for failing to remove the Bible and other religious materials from his classroom but also found other issues about his teaching and behavior.
So, he's been doing this for eleven years and only got nailed, not because of complaints from parents but because he refused to remove his book from the desk. So does the school and district condone this behaviour and share his beliefs and only stepped in when they couldn't dodge it anymore, or are they criminally negligent?

Irregardless, this is a fine man...a fine upstanding example of "faith". Congrats buddy, I hope they lock you up but I'm sure you'll be absolved and be back teaching by the beginning of the next year.

MOUNT VERNON, Ohio (AP) - A public school teacher preached his Christian beliefs despite complaints by other teachers and administrators and used a device to burn the image of a cross on students' arms, according to a report by independent investigators.

Mount Vernon Middle School teacher John Freshwater also taught creationism in his science class and was insubordinate in failing to remove a Bible and other religious materials from his classroom, the report said.

School board members were scheduled to meet Friday afternoon to discuss the findings by consulting firm H.R. On Call Inc., hired by the district to investigate. The report was released Thursday.

School Superintendent Stephen Short wouldn't comment on the report before Friday's meeting, his office said. A message seeking comment was left for Freshwater's attorney, Roger Weaver.

The report comes one week after a family filed a federal lawsuit in Columbus against Freshwater and the school district, saying Freshwater burned a cross on their child's arm that remained for three or four weeks.

Freshwater's friend Dave Daubenmire defended him.

"With the exception of the cross-burning episode ... I believe John Freshwater is teaching the values of the parents in the Mount Vernon school district," he told The Columbus Dispatch in a story published Friday.

Several students interviewed by investigators described Freshwater, who has been employed by the school district for 21 years, as a great guy.

But Lynda Weston, the district's director of teaching and learning, told investigators that she has dealt with complaints about Freshwater for much of her 11-year term at the district, the report said.

A former superintendent, Jeff Maley, said he tried to find another position for Freshwater but couldn't because Freshwater was certified only in science, the report said.

Freshwater used a science tool known as a high-frequency generator to burn images of a cross on students' arms in December, the report said. Freshwater told investigators he simply was trying to demonstrate the device on several students and described the images as an "X," not a cross. But pictures show the images depict a cross, the report said.

Other findings show that Freshwater taught that carbon dating was unreliable to argue against evolution.

MOUNT VERNON - The independent investigating firm HR on Call Inc. has completed its investigation into various allegations against Mount Vernon Middle School science teacher John Freshwater. The resulting report describes the scope of the investigation and outlines the investigative process. In addition to reviewing various documents and Freshwater's personnel file, the investigators talked with a number of parents, other staff members, students and Freshwater himself.

The report also gives an overview of what the investigators discovered with regard to each of the allegations against Freshwater, summarizes Freshwater's responses and includes supporting documents such as copies of photographs of an injury to a student.

The key findings of the report are quoted below.

•Mr. Freshwater did burn a cross onto the complaining family's child's arm using an electrostatic device not designed for that purpose. While there did not appear to be any intent by Mr. Freshwater to cause injury to any student, he was not using the device for its intended purpose. Contrary to Mr. Freshwater's statement he simply made an "X" not a "cross," all of the students described the marking as a "cross" and the pictures provided depict a "cross."

•The Ten Commandments together with other posters of a religious nature were posted in Mr. Freshwater's classroom. Most were removed after Mr. White's letter of April 14, 2008, but at least one poster remained which Mr. Freshwater was again instructed to remove on April 16, 2008, but did not do so.

•Several Bibles were kept in Mr. Freshwater's classroom including his personal Bible on his desk and one he checked out of the library placed on the lab table near the desk. Other Bibles that had been maintained in the room were removed by the time the investigators viewed Mr. Freshwater's room.

•Mr. Freshwater engaged in teaching of a religious nature, teaching creationism and related theories and calling evolution into question. He had other materials in his classroom that could be used for that purpose.

•Mr. Freshwater engaged in prayer during FCA meetings in violation of the district's legal obligations for monitoring such organizations.

•Mr. Freshwater participated and possibly led a prayer during an FCA meeting that concerned a guest speaker's health. There is no conclusion as to whether such prayer was a "healing" prayer.

•There is no evidence Mr. Freshwater violated the district's permission slip policy.

•There is no evidence Mr. Freshwater made statements about FCA members "being the saved ones" nor was there any corroboration to the allegation Mr. Freshwater gave FCA members Bibles for them to distribute. He did have two boxes of Bibles in the back of his room.

•Mr. Freshwater gave an extra credit assignment for students to view the movie "Expelled" which does involve intelligent design.

Superintendent Steve Short said the school board has scheduled a special session for 1 p.m. today to review the findings.

I actually saw this a few days ago. My first question, nerdily, was what exactly was that machine he used to embed the crosses - he didn't actually brand the kids, per se.

Here' is a perfect example of the downside of tenure in the American education system. I'm not going to get into what a nut job the guy is, because that's an open and shut case. My point is that unfortunately, a teacher - even a bad one - has to do something vile enough to actually leave physical evidence on a kid before he can be fired.

Teachers have very good unions, at least in the Great White North. And I hear it's similar down south. Though I don't even the teachers union would defend this guy, they probably provided him with a lawyer though as part of his benefits.

The strength of the teachers' unions in the States tend to vary from district to district, and according to which of the two national unions they look to. For things like tenure and benefits, they're stronger than death. However, for the pay scales in the CBA's, support when conflicts with administration arise, etc., they can and sometimes are weaker than well water.
