A sociopath is basically someone who knows right from wrong but does not care about the distinction. I'd argue that it is a mental illness and IIRC it's defined as one in the DSM under different terms, but it's a type that really doesn't require institutionalization because there isn't really a cure. There is treatment but that needs to happen before a crime is committed.
