Yes, your supposed to use your right foot for the gas and brake and only use the left if you drive a manual.

Anyway - is this guy American? His company has to be bonded for that sort of thing. In the US, at least, we have "assumed risk" or "occupational hazard" regulations. Sure, he should be compensated, but he shouldn't be able to litigate.
